1. ACCEPTANCE OF TERMS

Welcome to NYAAYSAARTHI. These Terms of Service ("Terms") govern your use of the NYAAYSAARTHI digital legal operating system, website, software, and associated services (collectively, the "Platform").

By creating an account, accessing, or using our Platform, you agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.

2. DESCRIPTION OF SERVICE

NYAAYSAARTHI provides software tools for legal professionals to manage cases, clients, documents, and workflows. We also integrate Artificial Intelligence (AI) to assist in legal research, drafting, and analysis.

We are not a law firm and do not provide legal advice.

3. USER ACCOUNTS & RESPONSIBILITIES

  • Eligibility: You must be at least 18 years old and capable of forming a binding contract.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • Accurate Information: You agree to provide true, accurate, and complete information during registration and keep it updated.
  • Authorized Access: You may not share your account access with unauthorized individuals. Chamber plans must be utilized according to their specified seat limits.

4. USE OF ARTIFICIAL INTELLIGENCE (AI)

Our Platform utilizes advanced AI models to provide drafting assistance, summaries, and legal insights.

  • No Legal Advice: AI outputs are generated for informational and preparatory purposes. They do not constitute legal advice or authoritative legal opinions.
  • Professional Judgment Required: You, as a qualified legal professional, are solely responsible for verifying the accuracy, relevance, and applicability of any AI-generated content before using it in a professional capacity or court of law.
  • Hallucinations: AI systems can occasionally produce inaccurate or fabricated information ("hallucinations"). Independent verification of citations and legal statutes is mandatory.

5. DATA PRIVACY & SECURITY

Your privacy is crucial to us. Our data processing practices are governed by our Privacy Policy.

We comply with the Digital Personal Data Protection (DPDP) Act, 2023. By using our Platform, you consent to the collection and use of your data as described in the Privacy Policy.

6. INTELLECTUAL PROPERTY

Our Content: All rights, title, and interest in and to the Platform (including software, UI/UX, algorithms, and design) belong to Hungry Minds Software Pvt. Ltd. and its licensors.

Your Content: You retain all rights to the data, documents, and client information you upload. By uploading, you grant us a limited license to process this data solely for providing the Service to you.

7. PROHIBITED ACTIVITIES

You agree not to:

  • Reverse engineer, decompile, or disassemble the Platform.
  • Use the Platform for any illegal, unethical, or unauthorized purpose.
  • Attempt to bypass security protocols or access data belonging to other users.
  • Upload malicious code, viruses, or disruptive software.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law, NYAAYSAARTHI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the platform or reliance on any AI-generated outputs.

9. TERMINATION

We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or engage in fraudulent activities. Upon termination, your right to use the Platform ceases immediately.

10. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by the laws of India. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Uttar Pradesh, India.
